A single traffic violation can result in a 25% increase in your auto insurance premium. North Carolina has a Safe Driver Incentive Plan, a point classification system based upon one’s driving history and prior convictions for traffic violations. The points system applies to traffic violations; a single point will result in a 25% increase to your insurance payment. Two points will result in a 45% increase.

The NCDMV also has a separate point system from the insurance point system whereby points are assessed to one’s driving record based upon the violation(s) committed. The accumulation of DMV points can result in a revocation of your driving privilege. Also, one’s driving privilege can be suspended for two (2) convictions of speeding in excess of 55 mph within a calendar year.

What is a DWI?

DWI is a criminal offense that is often referred to as drunk driving or DUI (driving under the influence) in other states. A person may face criminal charges for operating a motor vehicle while impaired by alcohol or a controlled substance. To secure a conviction for DWI in North Carolina, the prosecuting attorney must prove one or both of the following key elements:

  • The driver had a blood alcohol concentration (BAC) of .08% or greater, or
  • The driver’s normal abilities were impaired due to alcohol or drugs

The prosecution must also prove that the defendant was operating a motor vehicle on a street or highway or a public vehicular area. The District Attorney may utilize physical evidence obtained during an intoxilyzer or blood test to show that a driver had an illegal blood alcohol concentration, and/or the arresting officer’s testimony regarding the driver’s performance on field sobriety tests. Although a prosecutor may try to prove both factors to seek a conviction, evidence of only one may be sufficient. In the state of North Carolina, there are many different types of field sobriety tests that can be used by law enforcement officers after they pull over a driver.
